In a groundbreaking initiative, Chicago Mayor Brandon Johnson has mandated the Chicago Police Department to investigate and document alleged illegal activities conducted by federal immigration agents, specifically those from Immigration and Customs Enforcement (ICE). This executive order, titled “ICE on Notice,” is set to intensify the ongoing jurisdictional tensions between local and federal authorities.

The directive establishes a clear protocol for Chicago police officers to follow when they observe or receive reports of ICE agents engaging in unlawful actions. Officers are now empowered to gather evidence of potential violations and refer these findings to city prosecutors. “Nobody is above the law,” Johnson stated in a recent post on Twitter/X. “With today’s order, we are putting ICE on notice in our city. Chicago is leading the way as the first city to create infrastructure for holding ICE and Customs and Border Protection (CBP) agents accountable for crimes against our communities.”

This executive order comes on the heels of a federal judge’s ruling that denied Minnesota’s request to temporarily block the state’s immigration crackdown. The court dismissed arguments suggesting that federal immigration enforcement in Minnesota violated the Tenth Amendment, which limits federal powers. Conversely, Chicago’s approach seeks to carve out a distinct path, asserting local authority to investigate and potentially prosecute the actions of federal law enforcement in the city.

Despite the bold nature of this order, federal authorities typically reserve the right to obstruct local inquiries. Historically, federal judges have upheld federal authority over local jurisdictions, particularly concerning immigration matters. However, city officials have expressed that this measure is a necessary response to immigration operations that have allegedly compromised constitutionally protected rights, destabilized communities, and incited life-threatening confrontations while evading local oversight.

The order includes several provisions aimed at enhancing transparency and accountability. Chicago police are required to preserve any body-camera footage captured during incidents involving federal agents, identify the federal supervisory officer present, and report any violations of state or local laws by those agents.

The Cook County State Attorney’s Office has also expressed its commitment to public safety and legal accountability, emphasizing the importance of collaboration with law enforcement partners. The directive comes amid growing concerns that ICE operations may intensify in Chicago as federal activities in Minneapolis begin to wind down.

In a related effort, Mayor Johnson previously signed an executive order in October that designated city-owned parking lots, vacant lots, and garages as “ICE-free” zones to limit federal agent activities. Last week, he further called for a national civil rights movement in response to federal immigration actions, asserting, “This moment calls for boldness—not some sort of pragmatic pragmatism to a tyrant.”

Johnson criticized a historical tendency to capitulate to powerful interests, emphasizing the need for a more proactive approach to safeguarding the rights of working people. His administration is exploring avenues not only to investigate and charge federal overreach but also to establish processes for prosecuting individuals involved in unlawful activities.

In contrast, former President Donald Trump has weighed in on the situation, indicating that he will not deploy federal resources to address protests in “poorly run” Democratic cities unless explicitly requested. In a post on Truth Social, Trump stated, “We will, however, guard, and very powerfully so, any and all Federal Buildings that are being attacked by these highly paid lunatics, agitators, and insurrectionists.”

As Chicago embarks on this unprecedented initiative, it stands at the forefront of a national conversation about immigration enforcement, local autonomy, and the accountability of federal agents operating within city limits. The implications of this order could resonate far beyond Chicago, potentially influencing similar actions in other cities grappling with the complexities of immigration policy and enforcement.
